Triposo API Platform and Data Use Policy
Users of the Travel Guide with Offline Maps BV ("Triposo") application programming interface ("API")
and Triposo Data (which includes Triposo generated and owned data) and Third party data
( owned by third parties, governed by their respective usage policies and distributed through the API),
collectively known as Travel data, are required to comply with Triposo's API License Agreement and the terms and conditions of this Policy.
I. General
- Your use of the API and the Travel Data, including the collection, use, maintenance and disclosure of user data ( if any) shall comply with all applicable laws, rules and regulations and the terms of this Policy, and any advertising, marketing, privacy, or other self-regulatory code(s) applicable to your industry.
- You must not take any action that constitutes unauthorized or unsolicited advertising, junk or bulk e-mail.
II. Authorization
- You must take commercially reasonable steps, compliant with applicable laws, rules and regulations, to protect all data you collect, obtain or access through the API and your authentication key from unauthorized use, disclosure or access.
- You must not give your authentication key to another party and you take responsibility for any and all use of the API using your authentication key.
- Triposo may revoke your authentication credentials at any time, for any reason or no reason, with or without notice, and without liability to you or any other person.
- You must notify us immediately in the event of any unauthorized access to the API, your authentication key, and/or your application and/or website.
III. Access/Use
- You will only request the Travel Data you need to operate your application and/or website and must make no further use of it and delete it when your application and/or website has no such further use for it.
- Triposo expressly reserves the right to limit the number and/or frequency of API requests in its sole discretion. If Triposo reasonably believes that you have attempted to exceed or circumvent the rate limits (including, without limitation, through mass-registering of applications), your ability to use the API may be temporarily or permanently blocked, with or without notice, and without Triposo liability to you or any other person.

If your application and/or website collects, obtains or accesses any information about its users or submits any user information to Triposo, whether acting as a user of your application and/or website or indirectly:
- You must prominently notify and obtain affirmative consent from the user before his or her location data is collected or used by your application and/or website. The notification must clearly disclose that both you and Triposo collect and use the user's location data;
- Your application and/or website may not falsify the location of a user when communicating with Triposo.
- If your application is using the Triposo API to build an integration that is similar to the essential user experience of Triposo by providing services around destination discovery, search, or recommendations, you may be subject to additional terms.
- Access to the API is provided for free for a limited number of API calls and is then governed by the API pricing policy.
IV. Retention

The retention of our data is dependant on the plan that you have chosen in your API console. Plans and related parameters are mentioned at our pricing page.

Developer plan
- You will not cache, index, or store any Content to be used outside the Service, except temporary caching that doesn’t last longer than one of your user sessions upto a maximum of 24 hours.

Business plan
- You may store data you receive through use of the API in order to improve your application's and/or website's user experience. The terms of the data storage and usage is governed by an additional contract between Triposo and the Business plan consumer

The following sections apply to all plans
- If you stop using the API or we disable your application and/or website, you must delete all Travel Data.
- Notwithstanding the foregoing, in the event Triposo (a) ceases to provide the API or its database through the API or (b) elects to charge for even limited access to the API or its database, and you elect not to continue to use the API and/or Triposo's database because of such charges and you notify Triposo in writing of the same (each a "Transition Event"), Triposo hereby allows you to retain the Transition Information (as defined below) for a period of 1 month after the Transition Event ("Transition Period") while you transition your service and/or website to a different database. If at any time during the Transition Period you transition to a new database, the license from Triposo automatically terminates and you must delete any such Transition Information within 15 days after such transition. For the purposes of this Policy, "Transition Information" means any information that you accessed via the Triposo API prior to the Transition Event.
V. No Transfer
- You will not directly or indirectly transfer any Travel Data. By "indirectly," we mean you cannot, for example, transfer data to a third party who then transfers the data to another third party. By "any Travel Data," we mean all data obtained through use of the API, including aggregate, anonymous or derivative data.
- You will not sell, rent, or transfer any Travel Data. If you are acquired by or merge with a third party, you may continue to use user data within your application and/or website, but you may not transfer data outside your application and/or website.
- Independant access to third party data outside of the Triposo API is permitted and governed by the terms of usage of the third party data
VI. Privacy Policy

If you collect, use, store or disclose any user data:
- You must provide a privacy policy to users of your application and/or website that clearly discloses how you collect, use, store and disclose user data, including that you share user data with Triposo, for use by Triposo for its own purposes
- You must clearly and conspicuously present your privacy policy to each user at the point of application and/or download, installation, authorization or first-run, and you must also make the policy available in the mobile application or from the home page of your website.
- Your application and/or website must not collect personally identifiable information of any user unless it first informs the user about the types of information being collected and how that information may be used and then obtains the user's express permission for those uses.

Triposo will have no liability whatsoever if you violate any terms of privacy related to user data, including
but not limited, to any violations of SEC. 13 OF EU REGULATION NO. 679/2016 (commonly known as
“GDPR”)
VII. Attribution/Trademarks

In connection with your use of the API and Travel Data you must comply with our Attribution Policy
- Travel Data comprises of information from multiple open source web databases and other APIs ( “Third Party Data”) and Triposo Data. Source details are provided in the API response and in the source end point. Please ensure that you attribute the relevant sources by name & provide a relevant link to the content source as mentioned in the API.
- Visual attribution - You can think of Visual Attribution like a citation in a paper, and the guideline here is simple: whenever Travel data is showing on the screen, attribution to the relevant source as provided by the API must be visible where the Travel data is shown.
Additionally, you are required to display all attribution information and any proprietary notices associated with the Travel Data that you collect, obtain or access through the API, including without limitation data from third party data providers.

Your application and/or website must not:
- Use business names and/or logos in a manner that can mislead, confuse or deceive users (e.g., do not copy the look and feel of the Triposo service);
- Confuse or mislead users about the source or purpose of your application and/or website;
- Impersonate or facilitate impersonation of others in a manner that can mislead, confuse or deceive users.
- You must not express or imply any affiliation or relationship with or endorsement by us.

If your application and/or website displays any Triposo logos or trademarks,
you must prominently include the following statement:
"All of the Triposo® logos (including all badges) and trademarks displayed on
this [application/service] are the property of Travel Guide with Offline Maps BV"
VIII. Permissions/Feedback
- By incorporating the API into your website or service, you agree that Triposo may collect and use information from you and your users with the sole purpose of improving the data returned to you through the Triposo API.
IX Acceptable Use
Triposo’s services (the “Services”) help people make the most of where they are by helping them discover interesting places and experiences nearby. You are responsible for all of your activity in connection with Triposo’s services (the “Services”). Additionally, you agree to abide by all applicable local, state, national and international laws and regulations and, if you represent a business, any advertising, marketing, privacy, or other self-regulatory code(s) applicable to your industry.
Things you can’t do:
- take any action that imposes or may impose (as determined by Triposo in its sole discretion) an unreasonable or disproportionately large load on Triposo's (or its third party providers') infrastructure;
- interfere or attempt to interfere with the proper working of the Services or any activities conducted on the services;
- bypass any measures Triposo may use to prevent or restrict access to Services (or other accounts, computer systems or networks connected to the Services) or tamper with, or use non-public areas of the Services, or the computer or delivery systems of Triposo and/or its service providers;
- run any form of auto-responder or "spam" on the Services;
- use manual or automated software, devices, or other processes to access or search or attempt to access or search the Services by any means other than through currently available, published interfaces that are provided by Triposo (and only pursuant to those terms and conditions) or unless permitted by Triposo.
- harvest or scrape any content from the Services;
- probe, scan, or test any system or network (particularly for vulnerabilities), or otherwise attempt to breach or circumvent any security or authentication measures;
- use the Services to send altered, deceptive, or false source-identifying information, including without limitation by forging TCP-IP packet headers or email headers;
- modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, republish, repurpose, sell, trade, or in any way exploit the Services or content except as expressly authorized by Triposo;
- decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Services except to the limited extent applicable laws specifically prohibit such restriction;
- copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder;
X. Triposo Obligations
Triposo does not guarantee any content available through the Services. Triposo has no obligation to monitor the Services and content. However, Triposo reserves the right to (i) remove, suspend, edit or modify any content in its sole discretion,without notice to you and for any reason to satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms of Use, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or(v) protect the rights, property or safety of Triposo, its users and the public. (vi) remove any offensive or illegal content posted by its users without any liability for the offending content.
XI. API Pricing
Triposo, at its sole discretion, defines the pricing policy for access to the API. Based on the volume of API credits you may be subject to a monthly license fee solely for the use of the API and Triposo Data. Third party data is free to use and its usage is governed by the terms and conditions of the respective source. Monthly fees are determined as follows -

- Each plan comes with a predefined number of API credits each month. If you require additional API credits you can either upgrade to a higher plan or purchase additional credits.
- API accounts will be suspended once the predefined monthly API credits are used up. Accounts can be activated by either upgrading to a higher plan or purchasing additional credits.
- It is your sole responsibility to maintain sufficient credits in your account and Triposo has no liability whatsoever in case of any disruption to your business or damage to your reputation due to account suspension
- All credits are non-encashable and non-refundable
- Billing and invoice related information will be available within your API console
